MADRID, 26 DE SEPTIEMBRE DE 2024. La Audiencia Provincial de Madrid ha designado al juez Juan Carlos Peinado como el responsable de investigar la querella presentada por Hazte Oír contra Begoña Gómez, acusada de haberse apropiado ilegalmente de un software desarrollado por la Universidad Complutense de Madrid (UCM). Esta querella fue originalmente gestionada por el Juzgado de Instrucción Número 48 de Madrid, pero el juez Juan Ramón Reig, tras una revisión del caso, decidió inhibirse, traspasando la responsabilidad a Peinado, quien ya investigaba a Gómez por posibles delitos de tráfico de influencias y corrupción en los negocios.
“Hay caso, eso es innegable. La Justicia está llevando a cabo un arduo trabajo para esclarecer la verdad pese a los constantes ataques e intentos de censura por parte del Gobierno. Pero frente al ‘fango’ que ellos esparcen, la verdad de los hechos resulta abrumadora, y nosotros estamos ahí para sacar todo a la luz”, ha declarado Ignacio Arsuaga, CEO de Hazte Oír.
Insatisfecho con el nuevo rumbo del procedimiento, el Ministerio Público apeló ante la Audiencia Provincial, la cual ha desestimado el recurso de la Fiscalía y ha confirmado a Peinado como el juez competente. Cabe recalcar que, en diversas ocasiones, el presidente del Gobierno ha hecho hincapié en el hecho de que la Fiscalía depende directamente del Gobierno, lo que ha afectado directamente a algunas decisiones adoptadas por este organismo.
Y es que los magistrados de la Sección Tercera explicaron que, aunque no tienen documentación precisa sobre los hechos que investiga Peinado, reconocen que estos están relacionados con la esfera pública, ya que el software en cuestión fue desarrollado gratuitamente y en exclusiva para el Máster en Transformación Social Competitiva, dirigido por la Sra. Gómez en la UCM.
Peinado ahora debe decidir si acepta la nueva querella de Hazte Oír y si suma estos nuevos hechos a los delitos que ya está investigando. En cualquier caso, este embrollo judicial determina que, en efecto, el Caso Begoña sigue su cauce y por tanto, existe y es relevante, lo que complica considerablemente la situación de Pedro Sánchez al frente del Gobierno de España.
Sánchez está verdaderamente preocupado por el devenir del caso judicial en el que está imputada su mujer. Prueba de ello es que, en medio de un desesperado intento por poner fin a las investigaciones, el jefe del Ejecutivo español trazó un proyecto que bautizó como “Plan de Regeneración Democrática”, que no es otra cosa que un programa para censurar a los medios de comunicación y organizaciones disidentes. Su intención radica exclusivamente en silenciar todas aquellas informaciones que puedan resultarle perjudiciales tanto a él como a su entorno y a su partido, lo que incluye, por descontado, el Caso Begoña Gómez.

The Provincial Court of Madrid has appointed Judge Juan Carlos Peinado as the one responsible for investigating the complaint filed by Hazte Oír against Begoña Gómez, who is accused of illegally appropriating software developed by the Complutense University of Madrid (UCM). This complaint was handled initially by Madrid’s Investigating Court No. 48. Still, after reviewing the case, Judge Juan Ramón Reig recused himself, transferring the responsibility to Peinado, who was already investigating Mrs. Gómez for possible crimes of influence peddling and business corruption.
«There is a case, that is undeniable. The judiciary is trying hard to uncover the truth despite the government’s constant attacks and censorship attempts. But in the face of the ‘mud’ they are throwing, the facts are overwhelming, and we are here to bring everything to light», said Ignacio Arsuaga, CEO of Hazte Oír.
Dissatisfied with the new direction of the proceedings, the Public Prosecutor’s Office appealed to the Provincial Court, which has dismissed the appeal and confirmed Peinado as the competent judge. It should be noted that, on several occasions, the Prime Minister has emphasized that the Public Prosecutor’s Office is directly linked to the government, which has directly influenced some decisions adopted by this entity.
The magistrates of the Third Section explained that, although they lack precise documentation on the facts being investigated by Peinado, they acknowledge that these are related to the public sphere, as the software in question was developed free of charge and exclusively for the Master’s in Competitive Social Transformation, directed by Mrs. Gómez at UCM.
Peinado must now decide whether to accept Hazte Oír’s new complaint and add these facts to the infractions already under investigation. This legal entanglement confirms that the ‘Begoña Case’ is ongoing and relevant, significantly complicating Pedro Sánchez’s position as head of the Spanish government.
Sánchez is genuinely concerned about the course of the judicial case in which his wife is implicated. Proof of this is that, in a desperate attempt to end the investigations, the Spanish Prime Minister devised a project he named the «Democratic Regeneration Plan», essentially a program aimed at censoring media outlets and dissenting organizations. His intent is solely to silence any information that could damage him, his party, or his circle, which undoubtedly includes the Begoña Gómez Case.
